GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern the offer and sale of products marketed through the Site.

2. Scope of Application

These General Conditions apply to all purchases made through the Site by users who qualify as consumers under Legislative Decree 206/2005 (Consumer Code).

By placing an order, the customer declares to have read, understood, and fully accepted these conditions.

3. Products

The essential characteristics of the products are described in their respective product sheets.

The images published on the Site are for illustrative purposes. While committed to representing products as accurately as possible, the seller cannot guarantee that the colors displayed on the user's device perfectly match the actual colors of the product.

Slight chromatic differences between the displayed images and the received product do not constitute a lack of conformity.

4. Product Availability

Products are offered within the limits of actual availability.

If an ordered product is not available after the order is placed, the customer will be promptly informed and will receive a refund of any amounts already paid.

5. Prices

All prices indicated on the Site are expressed in Euro.

Roba Bestiale operates under a flat-rate tax regime; therefore, in accordance with current legislation, fees are not subject to VAT application.

Any shipping costs are indicated separately before order confirmation.

Roba Bestiale reserves the right to change prices at any time; however, products will be invoiced at the price in effect at the time of order confirmation.

6. Purchase Procedure

To make a purchase, the customer must:

  • select the desired products;
  • add them to the cart;
  • fill in the required information;
  • choose the payment method;
  • confirm the order.

Order confirmation constitutes the conclusion of the sales contract.

The seller reserves the right to refuse or cancel orders in case of:

  • incomplete or incorrect information;
  • suspicion of fraudulent activity;
  • unavailability of the product;
  • obvious errors related to the price or product description.

7. Payment Methods

Payment can be made using the methods available on the Site, including:

  • Shopify Payments (for Visa, Mastercard, etc.);
  • PayPal;
  • Klarna
  • Satispay
  • Bank transfer
  • Google Pay
  • Other local payment methods (for countries other than Italy)

In the case of payment by bank transfer, the order will be processed after the actual credit of the due amount.

8. Shipping and Delivery

Shipments are entrusted to selected logistics providers through the Packlink Pro platform, including, for example:

  • BRT;
  • GLS;
  • Poste Italiane;
  • InPost;
  • UPS.

The delivery times indicated on the Site are purely indicative and may vary independently of the seller's will.

The customer is responsible for the accuracy of the shipping data provided.

Any additional costs resulting from incorrect or incomplete addresses may be charged to the customer.

9. Right of Withdrawal

Pursuant to articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), the consumer customer has the right to withdraw from the contract within 14 days from the delivery of the product, without needing to provide any reason.

To exercise the right of withdrawal, the customer can access their User Account Area on the Site and use the specific return request procedure available for eligible orders.

The return request will be examined by the seller, who may approve it and provide the necessary instructions for returning the product.

Alternatively, the customer can contact customer service at servizioclienti@robabestiale.it.

Products must be returned within 14 days of communicating the withdrawal, intact, unused beyond what is necessary to verify their nature, characteristics, and functioning, and complete with any accessories and free gifts received.

The refund will be made after receipt of the returned goods and subsequent verification of their conformity.

Return shipping costs are borne by the customer, except in cases where the return is due to a product defect, a manufacturing error, a product damaged during transport, or a non-conformity with what was ordered. In such cases, return costs will be borne by the seller.

10. Personalized Products and Exclusion of the Right of Withdrawal

Pursuant to article 59, paragraph 1, letter c) of Legislative Decree 206/2005 (Consumer Code), the right of withdrawal does not apply to products made to measure or clearly personalized according to the customer's specific requests.

Examples include:

  • products made based on specific instructions provided by the customer;
  • products modified from the standard configuration on the Site;
  • products containing names, photographs, texts, or other personalized elements requested by the customer.

For such products, once production has begun, it will not be possible to exercise the right of withdrawal, except in the case of a defective, damaged, or non-conforming product.

Standard catalog products without personalization remain subject to the normal provisions on the right of withdrawal provided by current legislation.

11. Legal Guarantee of Conformity

All products sold to consumers are covered by the legal guarantee of conformity provided for in articles 128 et seq. of the Consumer Code.

In case of lack of conformity, the customer has the right to the remedies provided by current legislation.

Any defects must be promptly reported to servizioclienti@robabestiale.it.

Normal variations in color, size, or print positioning compatible with the technical tolerances of production and printing processes do not constitute a lack of conformity, provided they do not substantially alter the characteristics of the purchased product.

12. Customer Account

The customer can create a personal account on the Site.

The user is responsible for the confidentiality of their login credentials and all activities carried out through their account.

The seller reserves the right to suspend or close accounts used in violation of these conditions.

13. Intellectual Property

All content on the Site, including texts, photographs, illustrations, logos, trademarks, designs, and graphics, are protected by intellectual property laws.

Any unauthorized reproduction, distribution, or use is prohibited.

14. Limitation of Liability

The seller will not be liable for delays or failures to perform due to force majeure, unforeseeable events, or circumstances beyond its reasonable control.

The mandatory rights recognized to the consumer by applicable law remain unaffected.

15. Privacy

The processing of personal data takes place as described in the Privacy Policy available on the Site.

16. Applicable Law and Jurisdiction

These General Conditions are governed by Italian law.

For any dispute relating to the interpretation, execution, or validity of these conditions, if the customer is a consumer, the competent court will be that of the place of residence or domicile of the consumer, as provided for by current legislation.
